  1. What information do we collect and process?  

When providing our services, we may collect and process different kinds of data which we have classified based on whether they are information about you, acting on your own behalf as user of our Service and as the parent or guardian of your baby, or if they are data about your baby.

Your personal data (acting as user of our Service and parent/guardian of your baby), which includes the following:

Baby’s personal data, which includes your baby’s cries (audio data), and with your consent, your baby’s gender, and birthdate.

If you have accepted the Zoundream Terms and Conditions and registered as a user of our Services, we will process your personal data for the purpose of providing and managing our Services in accordance with the Zoundream Terms and Conditions, including but not limited to: the creation, setting and management of your Zoundream user account and profile, and where applicable, blocking it and/or proceeding to cancel or discontinuing it; contact you about matters related to our services (e.g. possible interruptions or modifications in relation to the Zoundream Service, as well as updates); and assist, manage and respond to possible requests, comments and/or queries that you make to us in relation to our Services through different communication channels, such as email, SMS or telephone calls.

For the Zoundream Service to work correctly, in accordance with what is indicated in the Zoundream Terms and Conditions, we need to collect and process your baby’s cries, which may be considered as personal data, since without them we cannot provide our interpretation and translation services.

When processing personal data for these purposes, the processing is carried out based on the performance of a contract to which you are a party by registering for our Services and accepting the Zoundream Terms and Conditions (Article 6.1.b) GDPR).

If there are dual guardianship roles, the one accepting the Zoundream Terms and Conditions and registering to our Services should ensure that the co-guardian is informed and in agreement.

If you consent, we will process your personal data to keep you informed of news about our Services through the contact methods that you have provided us (e.g., telephone and/or email).

The processing is carried out on the basis of the consent granted by checking the corresponding box when registering to our services (Article 6.1.a) GDPR).

We remind you that you can unsubscribe at any time through the mechanism enabled in the communication itself, as well as directly in the Zoundream Service App, under the "Manage My Account" section or contacting us via email at [email protected].

Your personal data will be processed to send you surveys related to the degree of satisfaction and operation of our Services in order to obtain your feedback to better understand the quality of our services and improve them.  

The processing is carried out based on the legitimate interest of Zoundream (Article 6.1.f) GDPR), which is considered prevalent, since only contact data of Zoundream’s clients will be processed for the sole purpose of expressing their opinions about Zoundream’s services.

Your personal information may be processed to comply with our legal obligations, possible judicial resolutions and other decisions determined by the authorities, including the communication of personal data to the security forces and bodies, whenever we have suspicions or indications of an action that may constitute an illicit and/or crime.

The processing is carried out based on the necessary compliance by Zoundream with a legal obligation to which it is subject (Article 6.1.c) of the GDPR).

 

As long as you consent, your baby’s personal data (i.e. baby’s cry recordings, age and gender) can be processed to enhance our technology and the functionality of the Zoundream Service, as this helps us to further understand and develop better tools, striving to make life happier and easier for both babies and parents.

These recordings and information will be stored as long as your Zoundream account remains active. If you decide to cancel your Zoundream account or discontinue using Zoundream Services, we'll either delete the recordings or anonymize them, ensuring they can't be traced back to you or your baby.

We remind you that you can withdraw the provided consent at any time directly in the Zoundream Service App, under the "Manage My Account" section or contacting us via email at [email protected].

  1. With whom do we share your personal data?

Your and your baby's personal data may be accessed or shared by the following third parties:

With all service providers acting as data processors, we’ve entered into the relevant data processing agreement as required by personal data protection regulations.

If the third-party services suppliers are located outside the European Economic Area (EEA), whenever your data is transferred to those service providers, we ensure that the suppliers have an adequate data protection level. To this end, we have put in place adequate measures, such as the use of Standard Contractual clauses adopted by the European Commission to protect your personal data.

  1. How to Manage and Exercise Your Rights with Zoundream

We inform you that you can exercise the following rights:

If you had given your consent for any specific purpose, you may withdraw that consent whenever you wish, without affecting the lawfulness of the processing based on the consent prior to withdrawal. You can manage and adjust your consent settings directly in the Zoundream Service App, under the "Manage My Account" section or contacting us via email at [email protected].

In any case you are entitled to lodge a complaint before the pertinent Supervisory Authority in your Region.

  1. How long do we store your data?

We will process personal data as long as you keep your user account active in Zoundream Service for the period necessary to comply with the purposes set out in this Privacy Policy, and once you have unsubscribed or cancelled, the data will be kept for the time necessary to exercise or defend possible claims and to comply with legal obligations.

In relation to the recordings of your baby's cries, if you haven't consented to the processing of this information to enhance our technology and Service functionality, please note that the recordings will be promptly deleted once the cry has been translated. If you've given consent, these recording will be retained for as long as your Zoundream account is active. Should you opt to deactivate your Zoundream account or cease using our services, we will either delete the recordings or anonymize them, guaranteeing they cannot be traced back to you or your baby.

The personal data processed based on the consent granted will be kept until the consent is withdrawn, and once withdrawn, in some cases, we may keep them for the period necessary for the formulation, exercise or defence of claims, requirements, responsibilities, as well as legal and/or contractual obligations, always being duly blocked.
